JUUL Vaping Lawsuit
If you or your child suffered an injury or illness while using a JUUL vape, you may be eligible to file a JUUL Vaping lawsuit. You might be entitled to compensation.
JUUL has been the go-to device for vaping. It has become popular among younger generations because of its compact and sleek design. High school students can carry it around in their pockets without anyone noticing. The manufacturer also provided a range of enticing flavors, causing non-smokers and former smokers to choose the e-cigarette over traditional cigarettes.
JUUL has marketed its product as a safer alternative to smoking cigarettes. The media shed light on the vaping epidemic for the range of medical problems it can cause, such as respiratory illness, lung damage, and other serious diseases. JUUL also faced backlash for its marketing campaigns which targeted teenagers and children. The fruit, dessert, and other flavored pods were a popular choice among the younger age groups.
At FrancoLaw, we understand the serious health effects associated with vaping. Many users have been led to believe using an e-cigarette was better and safer than smoking. Unfortunately, most JUUL pods contain dangerously high amounts of nicotine and other chemicals which lead to addiction and can cause serious medical conditions. You have the right to hold e-cigarette companies accountable for their negligent actions, misleading and deceptive marketing campaigns and misrepresenting the true risks and health dangers associated with their products.

What Is JUUL?
In 2015, JUUL Labs Inc. put its brand of e-cigarettes on the market. The company claimed that using its product is safer than smoking a cigarette. However, a single pod contains the same amount of nicotine as an entire pack of cigarettes and they do not have filters so they deliver a much higher concentration of nicotine than cigarettes.
E-cigarettes are designed to look like writing pens, USB flash drives, and other common products. These devices use a liquid that contains nicotine and various types of flavors, as well as propylene glycol and glycerin. The liquid is heated using a battery and heating coils. The liquid becomes a vapor, where it can be inhaled, which is why its use often is referred to as “vaping”.
JUUL currently holds more than a 75% share in the e-cigarette market – a major market that is expected to be worth $86.43 billion by 2025 – making it by far the most popular e-cigarette available to consumers. JUUL was popularized primarily due to the company’s aggressive online social media marketing campaign, which advertised its product as a “safer alternative” for individuals trying to quit smoking traditional cigarettes. Contrary to JUUL’s claims that vaping is a safer alternative to smoking cigarettes, recent studies have found that JUUL and other e-cigarettes actually expose users to a number of dangerous health risks commonly associated with cigarettes. These products contain dangerously high amounts of nicotine and other chemicals.
Since the introduction of their marketing campaigns, JUUL and other e-cigarette manufacturers have faced heavy scrutiny for their marketing tactics, with accusations that the companies were deliberately targeting youth in their advertising in an effort to create an entirely new generation of smokers. When JUUL first began marketing its products, its ads showed young people enjoying its products in various settings. The company relied heavily on social media aimed at a younger audience and touted its flavored products, such as mint, mango, and creme. It is estimated that 3.6 million middle school and high school kids now use e-cigarettes. These statistics show there is now an “epidemic” of e-cigarette youth smokers, which has raised concerns of communities, states, and even federal agencies.
The Food and Drug Administration (FDA) has recently stepped in to correct their misleading marketing claims, telling JUUL and others that there is no evidence to substantiate that their products are a safer alternative to cigarettes. The FDA has also received numerous reports of JUUL and other e-cigarette users, primarily teenagers and young adults, who have become addicted to these devices and even some who have suffered seizures and convulsions as a result of nicotine poisoning and toxicity.
Vaping Injuries and Side Effects
There are a number of serious adverse effects associated with nicotine dependence and e-cigarette use. Many e-cigarette users have reported the following:
- Severe addiction
- Cardiovascular disease
- Heart attack or heart problems
- Lung or respiratory failure
- Mental health or behavior issues
- Nicotine poisoning
- Pregnancy complication or birth defects
- Seizures
- Suicidal thoughts or attempts
- Stroke
- Other complications
In April 2018, the Journal of Pediatrics published a report about the carcinogenic effects of the flavoring chemicals used in vape juice to provide fruit flavors. Chemicals found in vape juice include diacetyl (a buttery flavor), formaldehyde (embalming fluid), toluene (an ingredient in paint thinners and commercial adhesives) and acrolein (used to kill off plant and algae blooms in irrigation canals and water treatment ponds). These chemicals can cause the development of bronchiolitis obliterans, a serious lung disease that is irreversible, and commonly known as “popcorn lung.” Symptoms of popcorn lung include coughing, wheezing, and shortness of breath, similar to the symptoms of chronic obstructive pulmonary disease (COPD). When heated, vape products can produce particles of heavy metals such as cadmium, chromium, lead, manganese, and nickel, all of which can become lodged in lung tissue. Some vape liquids contain nitrosamines, which are known to cause cancer.
As of February 2020, there have been over 2,800 cases of e-cigarette or vaping product use associated with lung injuries as well as 68 deaths in 29 states reported to the Center for Disease Control (CDC).
